Retail Terms and Conditions 1) All contracts for
sale are accepted by Gail Klevan Jewellery subject to these terms and conditions
to the exclusion of all other terms, conditions, representations or warranties.
Acceptance by its Customer of delivery of goods supplied by Gail Klevan
Jewellery shall constitute the Customer's acceptance of these terms and
conditions. 2) All copyright and intellectual property rights in the goods and their design are the property of Gail Klevan Jewellery, and the Customer agrees that it will not for any purpose copy the goods, commission copies of the goods or otherwise cause them to be copied by any person, company or other organisation. 3) The jewellery is hand-formed and individually decorated and is subject to minor fluctuations in shape, colour, and appearance and while Gail Klevan Jewellery will make all reasonable efforts to supply items similar to those displayed or already sold, no warranty is made as to the degree of similarity. 4) All goods are ordered subject to availability. Delivery will normally be within 3-6 weeks of receipt of order. 5) Gail Klevan Jewellery will accept no liability for shortages or damage unless notified in writing by the Customer within five days of delivery. 6) In no event shall Gail Klevan Jewellery be liable for damages whether as consequential damages or for loss of business, profits or otherwise, arising out of or in connection with the non-availability or delay in supplying goods ordered from Gail Klevan Jewellery, or the use or performance of any goods supplied by Gail Klevan Jewellery. 7) The goods are intended to be purely decorative artefacts and are provided on an “as is” basis. Gail Klevan Jewellery makes no warranties of any kind, either expressed or implied as to any matter including, but not limited to, warranty or fitness for a particular purpose or merchantability, exclusivity or results obtained from use of the goods. Gail Klevan Jewellery at its absolute discretion may repair or replace items which suffer breakage through no fault of the Purchaser. However Gail Klevan Jewellery reserve the right to charge for repairing items which show evidence of inappropriate use or handling. 8) Acrylic and other plastics are prone to damage when brought into contact with solvents including but not limited to perfume, insect repellent, aerosols, hair spray, hand creams and sun tan lotions. Gail Klevan Jewellery will not be liable for any solvent related damage howsoever caused, and requires that retail purchasers are made aware of the risk of solvents to these products. 9) Gail Klevan Jewellery will not be responsible for changes in colour due to strong natural or artificial light. 10) No property or title to goods shall pass from Gail Klevan Jewellery to its Customer unless and until the Customer has made full and complete payment to Gail Klevan Jewellery for those goods. The Customer shall indemnify Gail Klevan Jewellery against any loss or damage to the goods prior to the passing of property therein on or after delivery to the Customer. 11) Time for payment shall be of the essence. 12) The validity, construction and performance of any contract to which these conditions apply shall be governed by English Law. |
